Risk assessments are a legal obligation for all businesses. If you have five or more employees then the findings must be recorded in writing. The creation, review and updating of risk assessments is a huge burden to businesses. Most health & safety prosecutions include charges relating to risk assessment and recent legislation in the form of the Health & Safety Offences and Penalties Act 2008. Also, the sentencing guidelines issued by the High Court as part of two recent Appeal Cases have increased penalties for health and safety offences.

Diane Turner is a former Procurator Fiscal Depute who has spent the last seven years specialising in Health & Safety and Environmental Law. Diane is a specialist member of the International Institute of Risk and Safety Management and leads the Corporate Defence Team at Burness.

Drew Wotherspoon has over eight years experience of advising clients on IT solutions and services which improve business processes, make working practices more efficient and reduce overheads. Over the past two years his primary focus has been on data collection software and its adoption within the facilities management sector and public sector. Drew is a member of the BIFM (British Institute of Facilities Management).
